Terms of Service


This agreement (“Agreement”) is entered into by and between you (“User” or “Developer”) and Singularity Foundation LLC (“Company”, “We”, “Us”, or “Our”), a Washington limited liability company. By using our services, you are agreeing to these terms. Please read them carefully.

1. SERVICES

Singularity Foundation operates multiple online services (“Services”), providing AI model routing, chat interfaces, and other tools across various platforms. Users can interact with a variety of large language models and other generative AI technologies.

We may change or discontinue any part of the Services at any time, including the availability of certain models.

2. USERS AND DEVELOPERS

For the purpose of this Agreement, “Users” are individuals who interact with AI models and generate content with them.

3. OBLIGATIONS

Use of our Services by anyone under 13 years of age is prohibited. You represent that you are at least the age of majority in the jurisdiction where you live or, if you are not, your parent or legal guardian must consent to these Terms of Service and affirm that they accept these Terms on your behalf and bear responsibility for your use. Bots accessed via our Services may produce content that is not suitable for minors.

You agree not to use our Services to:

  • Violate the rights of another party or any applicable laws;
  • Violate any of these Terms or our policies, or policies of third-party providers that power the models available through our Services;
  • Reverse assemble, reverse compile, decompile, translate, or otherwise attempt to discover the source code or underlying components of models, algorithms, and systems used in our Services;
  • Abuse, harm, interfere with, reverse engineer, or disrupt our Services, the models, or their underlying technologies, such as by accessing or using them in fraudulent or deceptive ways, introducing malware, or spamming, hacking, or bypassing any protective measures;
  • Use our Services or the models in a prohibited fashion, such as by exceeding any rate limits set forth by us from time to time, or by repeatedly creating accounts without paying for access;
  • Use any method to extract data from our Services, including web scraping, web harvesting, or web data extraction methods, other than as permitted by these Terms of Service; or
  • Represent that AI-generated content is human-generated.

4. PAYMENT

Our Services may operate on a subscription basis. All aspects of subscription management and payment processing are handled by third-party payment processors, including Stripe and Paddle. We do not have access to financial information. These providers operate as independent data processors under GDPR and other applicable privacy laws.

We may change the price of our Services at any time. Notice of the change will be posted on the relevant service website or platform.

5. INTELLECTUAL PROPERTY RIGHTS

All material that you upload, publish, or display within our Services, and any results that you receive in response to your prompts (or other inputs) from models accessible via our Services (“Model-Generated Content”), will collectively be considered “Your Content.” You retain ownership of Your Content.

6. DATA PROCESSING AND PRIVACY

We use third-party service providers, including Auth0 (for authentication and account management), Stripe, and Paddle (for subscription and payment processing), which may process personal data under their own privacy policies. These providers comply with GDPR and other relevant regulations through Standard Contractual Clauses (SCCs) and other appropriate safeguards for data transfers outside the EU.

Data collected through our Services, including AI chat logs, is processed based on our legitimate interest in improving our services and detecting fraudulent activity. Data is stored in the United States and retained for a period of [X months] before deletion. Users have the right to request access, correction, deletion, or restriction of processing by contacting support@singularity-foundation.com.

Users in the EU may file complaints with their local Data Protection Authority if they believe their data rights have been violated.

7. DISPUTE RESOLUTION

Any disputes arising out of or relating to these Terms of Service, or your relationship with Singularity Foundation under these Terms of Service, shall be resolved by binding arbitration. This Agreement is governed by and construed in accordance with the laws of the State of Washington, without giving effect to any principles of conflicts of law.

8. PRIVACY POLICY

Our Privacy Policy is a separate document that explains how we collect, use, and protect User information. It forms part of these Terms of Service and is incorporated herein by reference.

9. LIABILITY

Singularity Foundation LLC is not liable for any damages, loss, or problems that arise out of or are related to the use of its Services.

10. MODIFICATION

We may modify these Terms of Service. If changes affect data processing or user rights, we will provide prior notice. Continued use of our Services after such notice constitutes acceptance of the changes.

11. TERMINATION

We may terminate your use of the Services at any time and for any reason, including for a violation of these Terms of Service, upon providing notice to you. You may terminate your use of the Services at any time by ceasing to use our Services.

Upon termination, all rights and obligations will be extinguished other than such rights and obligations which by their nature should survive, including, without limitation, ownership provisions, warranty disclaimers, limitations of liability, and dispute resolution provisions.
